Board grants conceptual-plan modification for Bluewater Bay PD after litigation changed access

County planning staff presented a modification request for the Bluewater Bay plan development after a lawsuit altered access rights across the Lateral D Canal, preventing construction of a previously negotiated bridge. Staff described which public benefits remain completed and which must be changed, then recommended the board grant final approval for the conceptual PD changes while requiring the applicant to secure subsequent preliminary-plan approvals.

"The request today is the applicant is seeking a modification to the approved public benefits along with an additional ingress egress driveway connection to 85th Street," planning staff said, describing completed right-of-way dedications, partial bridge design, and required intersection and pedestrian improvements tied to County Road 510 and 86th Avenue.

The applicant's representative, Anna Saunders, told the board staff had summarized the project accurately and offered to answer questions. Commissioners probed whether conceptual approvals run with the land and noted the preliminary PD approval had expired; staff clarified conceptual approvals and special exceptions run indefinitely under current county code even though preliminary approvals can sunset.

After discussion and confirming PZC and staff-level reviews remain required for preliminary approvals, the board voted to approve the conceptual-plan modification and directed staff to continue processing the applicant's subsequent plan submissions.
