Picture Rocks council places magistrate hearing in abeyance to allow permit process for chicken issue

At the July 6 meeting Borough Solicitor Chris Kenyon advised the council to place the District Magistrate hearing involving Stephen Vermeire in abeyance. Kenyon explained that if Vermeire applies for and is denied a permit by Codes, he would then have the option to request a zoning-variance hearing before pursuing the magistrate process.

Council member Dave Hitesman moved to place the hearing in abeyance and Mary Brink seconded the motion; the minutes record the motion carried. The council did not record a roll-call tally in the minutes. The abeyance preserves the opportunity for the party to seek administrative permit relief before the matter proceeds through the magistrate hearing process.
