Plan Commission approves combining Lots 3B and 5 at 603 North 9th Street to allow building construction

The Decatur City Plan Commission unanimously approved a petition from MLS Engineering LLC on behalf of RNA Investments LLC to combine Lots 3B and 5 at 603 North 9th Street so the owner can construct a building that would otherwise span the two lots.

Brett Miller of Miller Land Surveying told the commission that the owner, Mr. Reinhardt, owns both parcels and the combination is requested so the building can be sited without being constrained by the former property line. "He's looking to construct a building over the the property line," Miller said in his presentation.

A commissioner explained that if the parcels remained separate the proposed arrangement might force both buildings to meet Indiana fire-code sprinkler requirements, an outcome the board estimated in discussion could cost "probably 100 grand." The commission concluded the lot combination was the appropriate, economical administrative remedy and the chair called for a motion. The motion was seconded and carried by voice vote; no members of the public spoke either for or against the application.

The commission approved the lot combination; staff and the applicant were directed to proceed with the necessary recording and permitting steps so construction can move forward.
