Planning Board issues negative declaration for Lattintown resort, authorizes conditional approval draft

The Marlborough Planning Board voted to adopt a SEQRA negative declaration for the proposed Marlborough Resort at 626 Lattintown Road after an exhaustive Part 2 environmental review identifying several "moderate to large" potential impacts.

Town planner Pat Hines walked the Board through Part 2 of the Full Environmental Assessment Form, which flagged potential impacts to freshwater wetlands and associated buffers, stormwater and surface water (including a proposed packaged sewage plant with surface discharge), endangered species habitat (bat roosting), traffic, and visual impacts visible from Ridge Road. After discussion, the Board adopted the draft Part 2 findings and voted to issue a negative declaration (finding no environmental impact that would require an environmental impact statement) while noting that the record requires multiple outside agency approvals.

Board members directed the applicant and counsel to compile outstanding third‑party permits and to return with a list of conditions. The Board authorized its attorney to draft a conditional resolution of approval enumerating required permits and technical submittals — including DEC, Ulster County, and Health Department approvals, fire department comments on water supply and hydrant locations, final SWPPP revisions, and detailed access designs — before any building permits would issue. The applicant's team said they would address the memos and that they welcomed the Board’s conditions as a path forward.

The Board’s action moves the project from SEQRA review to a condition‑driven approval pathway; the Board cautioned that many items remain to be resolved and that outside agency lead times will govern schedule.
