Board approves Heritage Development West enclave certification despite public objections

The St. Johns County commission approved certification of Heritage Development West by a 3–2 vote, finding the record contains competent substantial evidence that the three parcels meet the statutory definition for an agricultural enclave under Chapters 163.3162 and 163.3164.

County staff and applicant counsel presented survey and GIS perimeter analyses, property appraiser classifications, timber management documentation and letters from utility and school providers. "When staff reviewed the application they came to the following conclusion based upon the application material submitted and staff's review: the application does demonstrate that the property satisfies the statutory definition of an ag enclave," counsel Robert Walters told the board.

Public speakers again urged denial, raising similar issues to earlier testimony: whether acreage and perimeter calculations satisfied the statute as of the required January 1, 2025 date; the adequacy of public services; and potential traffic and school impacts from thousands of dwelling units in the region. Dr. Asplen, speaking on school capacity, warned that large new development historically has required the district to borrow to build schools and that the district may need to do so again.

Commissioners who supported certification said staff's independent analysis and application exhibits provided the necessary evidence. Opponents said unresolved questions about bona‑fide agricultural operations and long‑term infrastructure burdens remained. The board asked staff and county attorneys to prepare written findings to support the decision under the statute.
