Commissioners consider interim moratorium on large battery energy storage projects

The Sedgwick County Board of County Commissioners reviewed a proposal to impose an interim development control (moratorium) on permitting for large Battery Energy Storage Systems, commonly known as BESS. Chair (speaker 3) said the moratorium would give staff time to analyze data‑center and battery proposals before the county adopts specific policy.

"So we'd like to put a stay on this, for a time," the chair said during the meeting, explaining the recommendation was initially for one year but could be shortened. Staff planner Scott (speaker 4) told commissioners the moratorium would create the runway needed because planners are already handling multiple solar and data‑center applications.

Presenter Kirk Sponsel (speaker 7) described a proposed threshold to exempt small residential batteries and target commercial installations: applications would be limited where energy storage is the property’s primary use or when a system exceeds 600 kilowatt‑hours. Commissioners questioned whether a full year was necessary; one suggested a six‑ or nine‑month moratorium to avoid losing momentum.

The chair said staff could return with background analysis at the formal Wednesday meeting and the board could set the moratorium length when it takes action. No formal vote occurred in the discussed segments; the proposal was placed on the agenda for the upcoming public meeting.
