Committee considers recorder fee increases and funding for document redaction

The committee discussed two related items affecting the Office of Recorder of Deeds: a technology allocation and proposed fee adjustments.

Ordinance 26‑098 would move approved FY2027 operating budget funds from the recorder technology fee account to the Recorder of Deeds to implement contracted document redaction functionality required under Delaware Senate Bill 3285 (Del. Laws No. 125), effective Feb. 8, 2026. Sponsors said the contract work is to bring the county into compliance and to implement confidential document redaction features.

Sponsors also previewed Floor Amendment No. 1 to Ordinance 26-099, which would change specific fees charged by the Recorder's office — for example, moving a $15 mortgage fee to $16. The sponsor estimated a $1 increase could generate roughly $400,000 in additional revenue and cited a broader annual revenue estimate range of approximately $1.15 million to $1.4 million depending on volume. Council members asked for clarity about study results used to justify the increase, whether the recorder (an elected official) should manage fees operationally, and whether the amendment should be debated on the full council floor where the amendment will be introduced formally.

Members agreed there would be an opportunity to address the amendment and its fiscal details on the council floor; no committee vote on fee changes was recorded at the meeting.
