Brian Head Council adopts mixed-use overlay ordinance after debate over R-1 inclusion

The Town Council voted 4-1 to adopt Ordinance No. 26-012 creating a Mixed-Use Overlay Zone that can apply to R-1, R-2 and R-3 properties with a one-acre minimum; the ordinance removes a prior ban on short-term rentals and requires Council legislative action to apply the overlay to specific parcels.

The Brian Head Town Council voted 4-1 on Aug. 11 to adopt Ordinance No. 26-012, establishing a Mixed-Use Overlay Zone that may be applied to properties in R-1, R-2 and R-3 zones with a one-acre minimum lot size. Council Member Martin Tidwell moved to adopt the ordinance and Council Member Duane Nyen seconded; the motion carried with Council Member Larry Freeberg voting no.
