Senate advances workers' compensation transparency bill creating medical-claims database (SB408)

Senator Myers described Senate Bill 408 as a measure to modernize Louisiana's workers' compensation medical reimbursement system by establishing a statewide medical claims database. The sponsor said the database would let the state use real Louisiana payment data to update and maintain the fee schedule, move toward electronic medical billing, strengthen timely-payment oversight, and attach penalties for payers who fail to report required data.

"SB 408 modernizes Louisiana's workers' compensation medical reimbursement system by creating an all workers' compensation medical claims database so the state can use real Louisiana payment data to update and maintain the medical fee schedule," Myers said. He added that the bill keeps the current fee schedule in place until a new schedule is developed through rulemaking and approved by the House and Senate labor committees, ensuring legislative oversight before major reimbursement changes take effect.

The sponsor moved final passage; the Senate opened the machines and recorded 33 ayes and 0 nays on final passage. The bill was ordered reengrossed and passed to third reading before final passage that day. Proponents argued the measure will bring transparency, accountability and data-driven decision-making to the workers' compensation medical system while protecting access to care for injured workers.
