Commissioners split on how to define 'qualified local' for fee deferral

Commissioners spent substantial time debating how the ordinance should define a "qualified local." Staff offered two primary options: Option A would apply the APHA working-local test (working at least 1,500 hours per year and deriving 70% of income locally, with a retirement exception); Option B would adopt a demolition-allotment style test that requires long-term ownership/occupancy (35 years).

Commissioners raised multiple edge cases during the exchange — inheritance, staged retirement, or families passing property to children who may not meet the working-local test — and questioned whether a workable, equitable definition exists. One commissioner asked, “What if somebody's lived here for 30 years?” as an example of how a line could produce unfair outcomes. Legal counsel and staff acknowledged those concerns and said the commission could recommend caps, sliding scales or administrative limits, but cautioned that income-based tests create administrative burdens.

Several commissioners said the proposal was simultaneously too broad (could benefit wealthy locals) and too narrow (would not help those living in deed-restricted APHA housing), and at least one commissioner argued the commission should recommend council reconsider moving forward.
