Commission approves Malmoth tentative parcel map with agricultural buffer and validation condition

The Planning Commission approved the Malmoth tentative parcel map (case 24 TPM 2) to subdivide a 9.67‑acre parcel in San Ynez into four lots ranging roughly 2.18–2.74 acres. Planner Tatiana Cruz summarized the project, noting the site is zoned 1E1 (single‑family residential) and that parcels will be served by the San Inez River Water Conservation District and on‑site wastewater systems.

Key conditions include a required 100‑foot agricultural buffer measured from the adjacent commercial agricultural property and a voluntary 200‑foot development restriction recorded on Parcel 4 to protect private views. Staff noted that single‑family dwellings and ADUs are allowed within the buffer as low‑intensity residential uses but that non‑habitable accessory structures have additional restrictions. Cruz also noted a mitigation and monitoring program under a Mitigated Negative Declaration; tree protection, bird‑nesting avoidance and erosion control measures were among the conditions.

Commissioners asked whether existing unpermitted structures on Parcel 1 could be validated; staff said the applicant had applied for a land‑use permit and that the validation path and required building permits would apply. Commissioner Martinez disclosed a site visit and raised concerns about how the buffer functions when existing dwellings encroach; staff and PND clarified the buffer's regulatory intent and that notice had been provided to the neighbor to the south. The commission moved, seconded and adopted the staff recommendation to approve the map and mitigation monitoring program.
