Oxnard staff cites emergency procurement code as repairs exceed purchasing limits

Staff asked the council to rely on Oxnard's emergency purchasing code and state Public Contract Code section 22050 to waive bidding for immediate sewer repairs, noting the updated purchasing policy caps similar task orders at $75,000 while the current emergency is expected to exceed that amount; staff said Toro Enterprises will perform most work and sought authorization for contracts over $220,000.

Jan Houser said the recommendation includes ratifying the director of public works' emergency order "to dispense with public bidding requirements pursuant to public contract code section 22,050" and asked the council to authorize the city manager to execute any contracts necessary to abate the emergency. Houser explained the city's purchasing ordinance 3053 and City Code section 4-30 that allow the director to take immediate action without plans, specifications, or bidding in emergencies.
