Representative Rutherford presses DPH on hallway beds and fire-code enforcement; DPH signals legislative fix

A prolonged exchange between Representative Rutherford and Department of Public Health officials focused on the practice of placing hospital beds in ER hallways during surge periods and whether enforcement or a legislative change is the appropriate response.

Representative Rutherford argued that hospitals facing capacity constraints — and physical differences between facilities — will need practical flexibility and that enforcement could force referrals or delays in care. "Do you all take the position that it is better that they send people away or that they triage them?" he asked. Dr. Simmer responded that triage is required, but DPH is working with hospitals and the hospital association to find alternatives (conference rooms, triage physicians) and plans to propose statutory language to allow hallway beds in narrow circumstances. He said DPH paused active enforcement while seeking legislative relief.

The exchange covered tradeoffs: hallway beds may worsen outcomes (higher infection rates cited by DPH) but may be the only immediate option in surge events. DPH urged the committee to consider a statutory fix and invited legislative sponsorship.
