Council adopts broad Unified Development Code clean‑up changes, clarifies curbside, screening, sign rules and timelines

Planning staff presented a package of targeted amendments to the Unified Development Code intended to clarify existing language and remove internal inconsistencies. The changes include removing curbside service from the definition of drive‑through restaurants (so curbside parking doesn't trigger drive‑through standards), defining "new construction" and when fencing/screening requirements apply, revising dumpster and refuse screening standards (25‑foot setback in standard districts; 5‑foot setback in form districts with alley exceptions), allowing electric fences behind security fences for vehicle/equipment inventory in certain commercial zones, and adding a public‑event sign permit with defined posting/removal rules.

Planner Wilter Parish explained the revisions were largely driven by prior ambiguities and stakeholder feedback, and that the planning & zoning commission recommended approval. Staff also proposed changing the allowed duration for approved planned developments to five years from approval to ensure consistency with state law. A public hearing drew no speakers. Council moved and approved the ordinance on first and final reading, with a minor edit to clarify the timing language for final acceptance of infrastructure.

Council members asked technical questions about accessory structures and surety bonds; staff clarified accessory structure counts are based on lot size and that surety bonds are set at 110% of the improvement cost with a two‑year maintenance period from final acceptance by the city engineer.
