Appomattox supervisors approve performance agreement with ADP Appomattox Data Hub LLC

The Appomattox County Board of Supervisors voted to approve a performance agreement with ADP Appomattox Data Hub LLC that ties annual payments to a stated percentage of certain tax revenues generated at the proposed data center site.

Supervisor Simpson moved to approve a written resolution authorizing execution of the performance agreement among Appomattox County, the Appomattox County Economic Development Authority, the Commissioner of the Revenue of Appomattox County and ADP Appomattox Data Hub LLC; Reverend Jones seconded to allow for discussion. "The performance agreement in the form presented to this board at this meeting and filed with the clerk is approved," the chair read as part of the resolution text.

The chair read clauses limiting county liability, stating that "nothing in this resolution or in this performance agreement constitutes a pledge of faith and credit or of the taxing power of the county," and that all financial obligations are subject to annual appropriation. The resolution also includes a condition that no officer of the county may execute the performance agreement until county counsel certifies in writing that it is in final form and that the authority has adopted a resolution approving execution.

During the roll call, the board recorded votes as follows: "Mister Simpson — Aye; Reverend Jones — Aye; Mister Willskill — Aye; Mister Hipps — No; [the chair] — Aye." The chair announced the resolution had been approved. The resolution also specifies that if the performance agreement has not been executed and delivered by all parties on or before 12/31/2026, the authority granted by the resolution will expire.

The chair said the fully signed and certified performance agreement will be available to the public once counsel has completed its review, estimating publication "in a week" or "two weeks."
