Commission denies six variance and conditional-use requests

The Planning and Zoning Commission voted unanimously to adopt six resolutions denying variance and conditional-use requests submitted by the same architect or engineering firm. The resolutions — recorded as 26-05R through 26-10R — covered requests to relax setback and parking standards and one conditional-use request for congregate housing.

Commission member S4 moved each resolution, and after limited discussion commissioners repeatedly cited incomplete application materials and a lack of demonstrated practical hardship as reasons for denial. Chair S1 put each motion to a roll call; each motion passed with three yes votes.

For example, on conditional use permit application 2026029 commissioners noted that "the emergency response plan and seasonal management contact were not provided for review," a public-health and safety condition the commission considered material to the decision. On several variance requests, commissioners said that maximizing lot usage did not constitute the practical hardship required to grant the relief requested.

The denials affect multiple proposed projects that sought to relax zoning standards—including setbacks and parking requirements—across industrial light and business historical zones. Under a recent change to code noted by the commission, applicants not adopted by the commission may now be taken to the Board of Appeals rather than being approved automatically under the prior code.

Commissioners did not record any amendments to the resolutions during the meeting. Parties wishing to pursue the applications further may seek appeal through the Board of Appeals or resubmit complete applications.
