Historic District Commission weighs adopting design guidelines into Land Development Code

The Historic District Commission spent its Feb. 26 workshop debating whether to adopt the city's revised Historic District design guidelines into the Land Development Code (LDC), a move staff said would give the guidance stronger enforceability but make future changes more procedurally complex.

"You could pick this entire thing up and incorporate it into the code," a planning staff member said during the discussion, arguing adoption by reference would make the guidelines enforceable. Staff cautioned that once adopted by reference the guidelines would be subject to the LDC amendment process—review by staff, the planning board and two readings at the city commission—reducing flexibility for incremental updates.

Commissioners raised concerns about gray areas in the guidance and how interpretation would be handled before items reach the board. One member said parts of the document are intentionally interpretive — "there's gray, like, a lot of grama" — and sought clarity on which elements would remain discretionary. Staff suggested keeping some checklist items and clear expectations in the guidelines while reserving interpretive calls for the board.

The Commission agreed on immediate next steps: staff will track proposed code-eligible items while the board drafts the revised guideline text. Chair noted at least one formal code change under consideration: referencing the revised design guidelines in the LDC so they carry more weight in regulatory review. No vote was taken at the workshop; staff will return proposed language for future action.
