Council asks city attorney to draft 'unauthorized gambling' definition for Title 2

Councilors heard confusion about existing gambling language and asked the city attorney to draft a local definition of 'unauthorized gambling' that targets venue revenue gains (the 'house' taking a cut) rather than informal fundraising by community groups.

The draft ordinance includes a broad state statute definition of gambling, but council members said they need a local definition of "unauthorized gambling" to capture the problem the city intends to prohibit: situations in which a license holder gains unauthorized revenue from gambling activity. Chief Wahl and others warned the city should avoid interfering with charitable activities (for example, Elks Club pull tabs or nonprofit fundraisers) where the license-holder does not take a profit.
