Box Elder County approves Capener Agricultural Protection Area after public hearing

The commission adopted Resolution #26-23 creating a 2,204.82-acre Agricultural Protection Area in the Riverside/Capener area after a public hearing; a resident who testified argued the designation is unconstitutional and raised property-rights concerns.

The Box Elder County Commission on July 22 approved Resolution #26-23 to create the Capener Agricultural Protection Area, covering 55 parcels and 2,204.82 acres in the Riverside area. County Clerk Marla R. Young told the board the application was submitted in April, notices were sent to property owners within 1,000 feet and reviews from Planning and Zoning and the Agricultural Board found the parcels zoned Agriculture Heritage Zone. Commissioner Lee Perry moved to adopt the resolution; Commissioner Boyd Bingham seconded and the motion passed unanimously by roll-call vote (Vincent, Bingham, Perry voting yea).
