Warrensburg amends solid-waste code to prevent double billing for builders

Council adopted Ordinance No. 6024 to clarify occupancy triggers for residential solid-waste billing (units are not deemed occupied until a TCO or CO is issued) and to allow only one service location per property unless billed as multiple units.

Community Development Director Carroll told council that builders sometimes pay both a temporary dumpster fee during construction and monthly solid-waste service when utilities are turned on but units are not yet occupied. Carroll said the amendment adds subsection 11-38(o) clarifying that a unit is not considered occupied until a temporary certificate of occupancy (TCO) or certificate of occupancy (CO) is issued, and subsection 11-38(p) limiting properties to one service location unless billed as multiple dwelling units. "Even if one or more water, sewer, or power services are being supplied to the unit, the unit will not be deemed occupied until a TCO or CO has been issued," Carroll said.
