Council presses developer for more dedicated open space and adherence to setback rules

Councilmembers flagged that the Legacy B Estates plan shows about 1.3% open space (approx. 0.2 acres) versus 5% required under R-3 code; perimeter setbacks in the revised layout produce new variance needs where neighboring parcels require 20–25 foot setbacks.

City Manager Dan Jessen told the council that R-3 zoning requires 5% dedicated open space (about 0.76 acres for the site) while the developer’s current plan provides roughly 1.3% (around 0.2 acres, largely detention pond area). Councilmember David Harris argued individual yard areas should not count as community open space in a leased-lot ownership model and said the project needed more dedicated common open space; the developer said they were willing to increase open space.
