Board members asked whether the applicant was being penalized because solar panels on the property may have been installed before local lot-coverage rules were changed to include panels. A staff member framed the issue: "Is he being penalized because he built the solar panels before the rule changed and now rules changed?" The board examined the record and a supplemental map and determined the addition would still push accessory coverage above the 2% limit even excluding panels.
