Staff described a special-use permit request for an accessory building on a lot that does not have a residence, and council questioned whether CC&Rs and HOA enforcement would reliably police conditions imposed by the Planning & Zoning Commission. Planning staff noted neighbors within 300 feet were notified and that the commission had added conditions, but councilmembers expressed concern some HOAs are inactive and may not enforce covenants.
