Planner Cassidy Brown explained the action as “cleanup” to align current zoning with historical and actual uses for the property, which she said has been used in the past as a hotel and convenience store and had other commercial uses. "The new property owners are looking to do a food truck on this property," Brown said, and staff recommended a variance to the minimum commercial district size so the zone change could proceed.
Agency comments were limited and favorable: Mark Berry with Lumen reported no conflicts, and Melissa Labor at BRS Engineering stated there were no abandoned mine land concerns. The Planning & Zoning Commission recommended the variance (4–0) and the zone‑up amendment (4–0) on Sept. 10.
Commissioner Jones moved to approve Resolution 25‑09‑Z‑002 (variance to minimum district size) and Commissioner Richards seconded; the motion carried unanimously. The board then approved Resolution 25‑09‑Z‑003 to amend the zoning map from agricultural to commercial for the same parcel; that motion also passed unanimously.
No members of the public spoke during the hearings. Staff noted that any additional public‑facilities or permitting requirements required for future uses will be addressed through the normal permitting process.
