Staff presented the application and said the corner lot’s geometry results in two front property lines and two rear lines, and that the proposed structure would encroach about 4 feet into the required 10-foot rear-yard setback. Planner staff told commissioners that, despite visibility from the right of way, existing fencing and landscaping and the site’s mature tree mitigate impacts and staff had no objection to the request.
Applicant William Sweeney told the commission that Highbury Crescent’s curve and the orientation of his lot make the rear yard unusual and limit placement options. He said he sought the variance after applying for a building permit and learning zoning requirements. "I used to have raised gardens in this same spot," Sweeney said, and described tree root zones, a planned room addition and gate access as reasons he cannot meet the standard rear-yard setback.
A neighbor, William Shore of 260 Highbury Crescent, spoke in support, saying Sweeney’s prior work improved property values and that he had no objection to the proposed location.
Commissioners questioned pad and anchor details, color and screening; staff clarified that structures under 200 square feet have different building-permit thresholds but that this proposal required the variance. Commissioner discussion referenced the lot’s acute angle and tree constraints as qualifying hardships. Commissioner Greenberg moved to approve the variance; Shapaca seconded, and the roll-call vote was recorded in favor. The motion passed.
Next steps: staff will resolve outstanding building comments and the applicant may proceed with required building permits before construction.
