Board denies variance to keep garage addition in Mukwa; staff cited options to comply

Summary
The Waupaca County Board of Adjustment denied Allan Lenz’s request to retain a garage addition placed without permits, concluding the owner could relocate the structure or combine lots to meet setbacks; the denial was unanimous.
The Waupaca County Board of Adjustment denied a variance Sept. 28 that would have allowed a garage addition on a Mukwa parcel to remain where it was built without required permits.
Applicant Allan Lenz told the board the addition was constructed in 2013 and that he has no other area on the parcel to place the structure. Mukwa Town Supervisor Lee Shaw testified in support, saying the parcel sits at the end of a narrow road and that the town had no plans to change the road width.
Planning staff, represented by Candace Bauer, recommended denial. Staff said requiring removal of the addition would not unreasonably prevent use of the property because the owner already had a dwelling and garage before the addition, the parcel does not present unique physical constraints compared with others nearby, and alternatives exist (including relocating the addition behind the house or combining lots) to meet setback requirements.
Board members noted there was room behind the house to relocate the structure and that combining lots could resolve the lot-line setback issue. Chair A. Richardson moved and M. Strebe seconded a motion to deny the variance; the motion passed unanimously (5–0). The board closed the hearing and later discussed scheduling future meetings; the next meeting was announced for Oct. 11, 2022.
